Terms of Service
These Terms of Service (“Terms”) govern your use of Project 2049 (the “Service”), a weekly essay by Takahiro Mitsui published by Takahiro Mitsui as an individual (“we,” “us,” or “our”). By creating an account, subscribing, buying a back issue, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
The Service consists of:
- Subscription. For $10 (USD) per month, you receive each new report by email, delivered every Friday at 5 p.m. Tokyo time, and can read on this website every report delivered while your subscription is active.
- Back issues. Reports delivered before your subscription began, or while you were not subscribed, can be bought individually for $2.50 (USD) each. Purchased back issues can be read in your account and sent to your own registered email address.
The table of contents of each report and a sample issue are available to everyone free of charge.
2. Accounts
- You must register with an email address you control and provide accurate information.
- You are responsible for keeping your password confidential and for all activity under your account.
- Accounts are for individual use and may not be shared, transferred, or sold.
- You must be at least 16 years old, or the age of majority where you live if higher, to create an account.
3. Subscription billing and renewal
- Your subscription is charged when you subscribe and then automatically every month on the same day.
- Your subscription renews automatically until you cancel.
- You may cancel at any time from your account or the billing portal. Cancellation takes effect at the end of the current billing period; you keep access until then.
- Payments are processed by Stripe. We do not store your full card details.
- We may change the subscription price with at least 30 days’ notice by email. The new price applies from your next billing period after the notice period. If you do not agree, you may cancel before it takes effect.
4. Back issue purchases
Each back issue is a one-time purchase, charged when you complete checkout. You may read a purchased back issue for as long as the Service is offered and your account remains in good standing.
5. Refunds
Because the Service is digital content made available immediately, all payments are final and non-refundable, except where required by applicable law or where the failure is caused by us.
6. License and acceptable use
We grant you a personal, non-exclusive, non-transferable license to read the reports for your own non-commercial use. You agree not to:
- forward, share, reproduce, republish, or redistribute all or substantial parts of any report without our permission;
- share your account or make purchased content available to others;
- scrape, copy in bulk, or use automated means to access the paid parts of the Service;
- use the Service in violation of any law or the rights of others.
You may use a report in a personal blog or newsletter if you clearly credit the source (Takahiro Mitsui, Project 2049).
7. Intellectual property
All content of the Service, including the reports, the name and logo of Project 2049, and the design of this website, is owned by Takahiro Mitsui or his licensors and is protected by copyright and other laws.
8. Suspension and termination
We may suspend or terminate your account if you breach these Terms or use the Service fraudulently or abusively. You may close your account at any time by contacting us. If your account is closed, you will no longer be able to access purchased content, and no refund will be given except as required by law.
9. Changes to the Service or these Terms
We may modify or discontinue the Service, or update these Terms. We will give reasonable notice of material changes by email or on this website. Continuing to use the Service after changes take effect means you accept the updated Terms.
10. Disclaimers
The reports express the author’s own views. The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or uninterrupted availability.
11. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, special, or consequential damages.
12. Governing law
These Terms are governed by the laws of Japan. Any dispute relating to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, unless the law of your place of residence requires otherwise.
